    2. General Terms of Use of the Site and the Services Offered

    Using the site avaeda.org implies full and complete acceptance of the general terms of use set out below. These terms may be modified or supplemented at any time, so users of avaeda.org are invited to consult them regularly.

    The site is normally accessible to users at all times. However, an interruption for technical maintenance may be decided by Avaeda, who will endeavour to inform users in advance of the dates and times of the intervention.

    The site avaeda.org is updated regularly. Likewise, the legal notices may be modified at any time; they nevertheless bind the user, who is invited to refer to them as often as possible in order to acquaint themselves with them.

    The purpose of avaeda.org is to provide information concerning all of the company’s activities.

    5. Intellectual Property and Counterfeiting

    Avaeda owns the intellectual-property rights or holds the usage rights over all elements accessible on the site, notably the texts, images, graphics, logo, icons, sounds and software.

    Any reproduction, representation, modification, publication or adaptation of all or part of the site’s elements, whatever the means or process used, is prohibited without prior written authorisation from Avaeda.

    Any unauthorised use of the site or of any element it contains will be considered an infringement and prosecuted in accordance with Articles L.335-2 et seq. of the French Intellectual Property Code.

    6. Limitation of Liability

    Avaeda cannot be held liable for direct or indirect damage to the user’s equipment when accessing avaeda.org, resulting either from the use of equipment that does not meet the specifications in Section 4 or from the appearance of a bug or incompatibility.

    Avaeda also cannot be held liable for indirect damages (such as loss of market or loss of opportunity) arising from use of avaeda.org.

    Interactive areas (the possibility to ask questions in the contact area) are available to users. Avaeda reserves the right to delete, without prior notice, any content posted in this area that violates French law, in particular provisions relating to data protection. If necessary, Avaeda also reserves the right to invoke the civil and/or criminal liability of the user, especially in cases of racist, insulting, defamatory or pornographic messages, regardless of the medium used (text, photograph, etc.).

    7. Management of Personal Data

    In France, personal data is notably protected by Law No. 78-87 of 6 January 1978, Law No. 2004-801 of 6 August 2004, Article L.226-13 of the Penal Code and the European Directive of 24 October 1995.

    When using avaeda.org, the following may be collected: the URL of links through which the user accessed avaeda.org, the user’s Internet access provider, and the user’s Internet Protocol (IP) address.

    In any event, Avaeda only collects personal information relating to the user for the needs of certain services offered by avaeda.org. The user provides this information with full knowledge of the facts, especially when they enter it themselves. It is then specified to the user of avaeda.org whether providing this information is obligatory or not.

    In accordance with Articles 38 et seq. of Law 78-17 of 6 January 1978 on information technology, files and civil liberties, every user has a right to access, rectify and oppose personal data concerning them, by submitting a written and signed request, accompanied by a copy of an identity document bearing the holder’s signature, and specifying the address to which the response should be sent.

    No personal information of the user of avaeda.org is published without the user’s knowledge, exchanged, transferred, assigned or sold on any medium to third parties. Only the hypothetical purchase of Avaeda and his rights would allow the transmission of such information to the potential purchaser, who would in turn be bound by the same obligation to retain and modify data with respect to the user of avaeda.org.

    The site is not declared to the CNIL because it does not collect personal information.

    Databases are protected by the provisions of the Law of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.

    8. Hyperlinks and Cookies

    The site avaeda.org contains a number of hyperlinks to other sites, set up with the authorisation of Avaeda. However, Avaeda does not have the possibility of verifying the content of the sites thus visited and will therefore assume no responsibility in this regard.

    9. Applicable Law and Jurisdiction

    Any dispute related to the use of avaeda.org is subject to French law. Exclusive jurisdiction is given to the competent courts of Paris.
